To operate effiectively, an association or company responsible for managing a private road or estate needs to be competent - that is, it needs to understand and address problems at the earliest possible stage. Being seen to be competent is, in addition, the best way to attract the support and confidence of residents, who are usually not under any legal obligation to join the association or company, or to pay the annual subscription. (Equally, demonstrating a lack of competence is the best way of losing support.) Many of the issues with which associations and companies have to deal are legal in nature, or have legal implications - for example: Rights of way Parking Maintenance of roads, trees, verges, etc Ownership of the road and assciated areas of land Risk management and insurance Development Relations with the local authority and other third parties Services Runing the association/company, including compliance with the Companies Act and the Data Protection Act. Our aim is to make available to our members the resources which will enable them to cope with these issues and function efficiently. Membership offers: A free copy of Private Roads: The Legal Framework in the first year (and a free copy when a new edition is published - usually every three or four years) Our online guide, Managing Private Roads and Estates, which complements the explanation of the law contained in Private Roads: The Legal Framework, and provides clear, practical guidance on what needs to be done. Regular newsletters, which deal with topics of current interest. Precedents, including model letters and model rules for associations and model memorandum and articles of association for a company, as well as our Code of Conduct for managing relations with developers. Archived correspondence with central government and other bodies. Access to solicitors with expertise in this area of the law, who can undertake work at a discount.
