Terms and Conditions

General

PRS membership and insurance are open to residents' associations and companies responsible for private estates in England and Wales. (It is not open to private individuals.) Since 1 April 2009, membership has been optional. The annual cost of membership is £75 for roads with 20 or more properties, and £50 annually for roads with less than 20 properties.

We run both membership and insurance to the end of the month. If both were started on (say) 15 April 2009 they would run to 31 March 2010. Membership in the first year would still cost £75 or £50, as appropriate; but the cost of insurance would be calculated on a pro rata basis, using the annual figures given in our literature. From 1 April 2010 onwards, membership and/or insurance could then be renewed for a complete year at time.

A small number of residents' associations and companies make use of managing agents. We regret that are unable to offer insurance or membership in such cases.

Personal data are handled by us in accordance with the Data Protection Act 1998. Where necessary for the purposes of an insurance contract they are shared with the insurers of the PRS insurance scheme; but they are not otherwise passed to any third parties.

Insurance

Insurance is offered subject to the terms and conditions of the insurers. Further information about the scheme is given in these pages and in our literature.

Payment of the premium is due no later than 7 days after the start of cover, or (in the case of renewal) no later than 7 days after the renewal date.

PRS is the sole broker for our insurance scheme. Queries about the scheme should be addressed to us at the address given on our home page; and insured parties should advise us promptly of any claim or potential claim or any incident or development relevant to the risk.

Membership

The membership fee (see above) must be paid no later than 7 days after the start of membership, or 7days before renewal is due, as appropriate.

Members are required to provide and use a single contact; that is, a resident who has the necessary access to the internet and email facilities, willing and able to act on behalf of the association/company, through whom all communications with us will be channelled. Our "one contact only" rule is essential if we are to operate efficiently, and we keep strictly to it. We do not retain or respond to emails, phone message or letters from anyone other than the agreed contact. We will agree to a change of contact at reasonable intervals, but not normally less than a year, in accordance with the procedure set out in our members' pages.

Members are entitled to one free copy of the current edition of Private Roads: The Legal Framework (further copies can be bought at half the normal price). They are also entitled to access the resources in our members' pages. Nearly all this material, including procedents, model letters, information and advice, can be accessed without further charge, but it is provided for the exclusive use of current members and must be destroyed or returned to us if membership ceases. For some precedents a small charge is made, and these may be retained and used after membership ceases.

It is the responsibility of the agreed contact to make sure that limitations on the use of PRS copyright material are respected. Further details are given in our members' pages.


We reserve the right to suspend or cancel membership, or to decline to renew it, if membership fees are not paid promptly or for breach of our "one contact only" rule or our rules relating to the use of copyright material.

Information, guidance and access to precedents and other materials is given in good faith, and we make every reasonable effort to ensure that they are accurate and reliable; but no liability can be accepted for errors and omissions.
